Terms
Updated October 9, 2026 / Version 2026-10-09
These are the terms Derelimitless Marketing works under. Derelimitless Marketing is the trade name of Derelimitless LLC, Springfield, Missouri. "We" means us. "You" means the business we build for.
Every client signs a one-page master agreement once, and each proposal is the statement of work under it. This page is the plain-English version of those terms. If your signed agreement or proposal says something different, the signed document wins.
01
Scope
- Scope is exactly what is written in your proposal. Anything else is a change order, priced and signed before work starts.
- Two rounds of revisions per milestone are included.
- Not included unless your proposal says so: copywriting, photography, logo design, moving content from an old site, and third-party fees.
- We fix defects for 30 days after launch at no charge. After that, fixes are part of upkeep. The 30-day fix period ends if anyone else changes the code, hosting or DNS.
- A proposal is good for 14 days.
02
You provide
- Your content (words, photos, logo and logins) by the dates in the schedule. Late content moves the schedule day for day. Published timelines start when your content arrives.
- Answers and approvals. We send a private staging link to review. If we hear nothing for 10 business days, staging counts as approved.
- Your own accounts. From day one you own your domain, Stripe, Apple and Google developer accounts, any phone number for your business, and every paid third-party service. You pay those providers directly. We are an admin user, not the owner.
- If you go quiet or miss a content date by 14 days, the project goes On Hold and restarts at our next open slot, with a restart fee in your agreement. After 60 days of silence the project closes and the full balance is due.
03
Payment
- A deposit holds your start date. No deposit, no start date.
- Websites and Business tools: 50% to start, 50% at ready to launch.
- Data products: 40% to start, 30% at a working demo, 30% at ready to launch.
- Platforms: 30%, 25%, 25% and 20%. The last payment is due at app store submission or 30 days after staging approval, whichever comes first.
- Ready to launch means staging is delivered and every reported defect is closed. It is not the go-live date. Nothing goes live before the balance clears.
- Bank transfer (ACH) is offered on every invoice. Card payments over $5,000 carry a 3% surcharge.
- Late invoices carry a 1.5% monthly late fee. Hosting is paused when any invoice is 15 days late.
- If you stop a build partway, a 25% kill fee applies, as set out in your agreement. No refunds once scoping has begun.
04
Upkeep
- Upkeep starts on launch day with a 12-month term, then runs month to month. After the first 12 months, you can end it with 30 days notice.
- Your level (Watch, Operate or Run) and what it covers are in your proposal and on our services page.
- We reply within one business day, and within four business hours when something is down. We do not offer 24/7 support.
- Upkeep unpaid for 15 days gets a notice. At 30 days the site is paused until it is paid.
- Upkeep prices rise 4% a year.
- If you leave upkeep, we transfer your repo, hosting and accounts within 10 business days, for the one-time hand-off fee in your agreement.
05
Who owns what
- When the final payment clears, you own your repo and everything built for you. Our shared library stays ours, and you may use it forever.
- You own your customer data. If you cancel, you get an export of it.
- While you are on upkeep, we run the hosting and database.
06
Liability and security
- Our total liability is capped at the fees you have paid us.
- If we learn of a breach that touches your data, we tell you within 72 hours.
07
Disputes
Missouri law applies. Any dispute goes to the courts of Greene County, Missouri. Before that, call or email us; most things get fixed on a call.
08
This website
Prices on this website are starting points, not offers. Your price is the one in your signed proposal. We keep this site accurate, but it comes as is.
